3. Inquiries, Estimates, and Proposals

Any pricing, timelines, recommendations, or other information shown on the Site or in response to an online inquiry are estimates only. They are based on typical engagements and do not constitute a binding offer.

Final pricing, scope, and contract terms are determined only after a written, signed proposal from Elegantly Curated covering your specific bespoke travel itinerary. Neither use of the Site nor submission of an online inquiry creates a contract or obligates either party to a transaction.

4. Intellectual Property

All content on the Site — including text, graphics, photos, illustrations, design, and code — is the property of Elegantly Curated or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and print pages for personal, non-commercial use only. Reproduction, distribution, or modification of any content for commercial purposes without our written permission is prohibited.

5. Third-Party Links and Tools

The Site may include links to third-party websites or embed third-party services (e.g., Google Analytics, GoHighLevel, payment processors, and our travel-supplier portals). We are not responsible for the content, privacy practices, or accuracy of third-party sites. Your use of any third-party site is at your own risk and subject to that site’s terms.

6. Disclaimers and Limitation of Liability

The Site and its content are provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied. To the fullest extent allowed by California law, Elegantly Curated disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.

Elegantly Curated is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including (but not limited to) lost profits, lost data, or business interruption. Our total aggregate liability for claims related to your use of the Site is limited to one hundred U.S. dollars ($100).

7. Travel Suppliers and Booking Terms

These Terms of Service govern your use of the website only. Travel arrangements made on your behalf are bound by the terms and policies of the underlying suppliers — airlines, hotels, cruise lines, tour operators, ground-transportation companies, insurers, and other travel providers. Elegantly Curated’s role is to advise, coordinate, and advocate on your behalf; we do not warrant the performance, pricing, or availability of those suppliers. Any deposits, cancellation windows, change fees, refund policies, and force-majeure clauses are governed by the supplier’s own terms disclosed at the time of booking and acknowledged in the signed travel agreement between you and Elegantly Curated. Nothing on this Site modifies, replaces, or supplements those separate agreements.

8. Communications and Consent

By submitting your phone number through any form on the Site, you consent to receive calls and text messages from Elegantly Curated about your inquiry and related information. Message and data rates may apply. You can opt out at any time by replying STOP to a text or by calling (858) 768-8973. Reply HELP for assistance.

9. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.

10. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
